Sony loses its first clash in Killzone Shadow Fall lawsuit war

You might remember, that back in August, Sony was sued because Killzone Shadow Fall multiplayer wasn’t true 1080p, as the box advertised. As a matter of fact, Killzone Shadow Fall’s multiplayer runs at 960 x 1080 — half the horizontal resolution. It was done to ensure a smooth frame rate and gameplay experience. But it’s true that it’s not true 1080p.

The Judge Edward Chen agreed gave a favorable verdict to plaintiff Douglas Ladore, who filed the class action lawsuit against Sony.

Sony reasoned that the game still outputs 1080p as an upscaled image, but the judge agreed that the case can continue because the image isn’t natively rendered at 1080p. Judge Chen said:

“Sony may ultimately be correct that Killzone outputs video in 1080p even in multiplayer mode. But Ladore does not allege that Sony misrepresented the final output resolution of Killzone. Rather, the heart of Ladore’s complaint is that Killzone’s multiplayer graphics were not originally created or rendered in 1080p – the output resolution was represented to be native 1080p when in fact it was not.”

It may seem to be a small thing to go to court over, but the plaintiff is technically correct: Sony promised and advertised true 1080p and did not deliver. The fact that the court is taking it seriously and moving the case to the next level could send a message to game developers in the future: make sure you deliver what you promise.
