The Last Ninja Scandal Continues!

Last week, the scandal between the Scandinavian metal group FastLoaders and System 3-boss Mark Cale exploded. We wrote back then that the story is far from being over – there are some updates about the issue between the parties.

As FastLoaders wrote in their Facebook announcement, „While we previously believed that we were entitled to use the branding, artwork and other materials that we used. Unfortunately, it appears that we were mistaken. It has now been explained to us that this is not the case.

System 3 does have rights in the LAST NINJA name and is entitled to exercise control over how their brand is used under the law of passing off. System 3 have established goodwill in the name LAST NINJA through many years of trading, irrespective of whether or not the name is registered as a trademark. They also own the copyright in the related artwork.”

Therefore, FastLoaders must find a way to strike a deal with System 3 to settle this argument. The result depends only on Mark Cale – will he finally allow Last Ninja Musicology to happen? If he still doesn’t give permission for this project to be official saying that the 2017 remake will be hurt by the Musicology, we can bid adieu to FastLoaders‘ idea…
