OpenAI Countersues Elon Musk!

TECH NEWS – According to the Sam Altman-led company, history is repeating itself, and Musk is trying to draw attention to himself.

 

OpenAI is filing a countersuit against Elon Musk, claiming the company’s co-founder is using bad-faith tactics to gain control of the industry-leading AI technology. Musk sued OpenAI and its CEO Sam Altman (another co-founder) last year to prevent him from changing the company’s structure from a non-profit to a for-profit company. It has been ten years since that happened: OpenAI was founded in 2015 by Musk and Altman. Musk left OpenAI in 2018, claiming the company had abandoned its founding mission of developing artificial intelligence for the benefit of humanity and was in breach of contract. He first filed the lawsuit in early 2024, then dropped it in June, and then refiled it last August. OpenAI responded with a fiery statement:

“Elon’s non-stop lawsuits against us are nothing more than bad faith tactics to slow down OpenAI and seize control of leading AI innovation for his personal benefit. Today, we filed a countersuit to stop him. Elon has never been about the mission. He’s always had his own agenda. He tried to seize control of OpenAI and merge it with Tesla for profit – his own emails prove it. When he didn’t get his way, he stormed out. Elon is undoubtedly one of the greatest entrepreneurs of our time. But these antics are just history repeating itself – Elon is all about Elon,” OpenAI wrote.

In December, OpenAI also published a timeline that it claims shows that Musk not only wanted, but actually created the for-profit as the proposed new structure for OpenAI. When he did not get majority ownership and full control, he walked away, saying OpenAI would fail. Now that OpenAI is the premier AI research lab and Elon is running a competing AI company, he is asking the court to prevent OpenAI from effectively pursuing its mission.

Last week, a California court set a March 2026 trial date for Musk’s lawsuit against OpenAI, but the court denied Musk’s request for an injunction against Altman’s plans. Judge Yvonne Gonzalez Rogers also said she expects Musk to present evidence in court…
