There have been some interesting developments around the big N this week (aside from the Japanese company confirming that the Switch successor will be backwards compatible with Switch games). The company has sued a streamer who was streaming “unreleased and pirated games” on public forums. TorrentFreak reported that Jesse Keighin (EveryGameGuru) was targeted by the big N for repeatedly leaking on YouTube, Discord, Twitch, TikTok, Trovo, Kicken, Vaughn, Dlive, Picarto, Nimo, Facebo, and Loco by hosting streams of emulated games. It was after several DMCA takedowns that the Japanese company got to this point.
“Defendant is a recidivist pirate who has repeatedly obtained and streamed Nintendo’s leaked games. Leaked games (sometimes referred to as ‘prerelease games’) are copyrighted video games that Nintendo has not yet released to the public. The use of emulators that circumvent these technological measures allows people like Defendant to play pirated Nintendo Switch games – including leaked games – on PCs, Macs, and Android devices,” the lawsuit reads.
What games were played? Super Mario RPG Remake, Super Mario Party Jamboree, Mario & Luigi Brothership, and allegedly Keighin encouraged viewers to play them and even linked to the games with the capital N, which is a serious violation of the company’s rights. He is seeking damages of $150,000 per infringement, which is a pretty hefty sum for an individual. (He might have to pay for the rest of his life, like Gary Bowser…)
And PocketPair has infringed on several patents with Palworld, and now the studio has revealed that Nintendo and The Pokémon Company are each seeking 5 million yen ($32,846) in damages. This is interesting because after the release of the game, the big N remained silent. It seems that Nintendo is bullying…
