The plaintiffs in the Activision Blizzard case now have the opportunity to file a complaint about the issues highlighted by the dismissal.
Activision Blizzard continues to be caught in the crossfire of litigation. It has been accused of fostering a hostile culture towards women, which has led to harassment and dismissals – and the industry is watching the case closely. Following these reports, the company has been sued by its employees and even by a group of investors for failing to take the ongoing investigations seriously.

However, wccftech reports a new development in the lawsuit brought by these investors: the case has been dismissed by US District Judge Percy Anderson. “Plaintiffs contend that the media’s reaction to news of the regulatory investigations and Defendants’ statement in response to the DFEH Action ‘belies any notion’ that the regulatory investigations were ordinary or routine,” the judge explains.
“Such allegations constitute ‘fraud-by-hindsight’ and absent particularized, temporal facts, are insufficient to support a claim of securities fraud,” the dismissal continues. “To the extent plaintiffs allege that defendants must have known sexual harassment and discrimination were endemic by virtue of their respective positions at the company, the [first amended complaint] does not establish the requisite facts to support such a conclusion.”
Although the judge dismissed the complaint, it also opened the door for the investor group to file a complaint within the next 30 days, reflecting the salient issues with the decision. On the other hand, it’s worth noting that Activision Blizzard is facing another sexual harassment and discrimination charge and has already had to pay millions of dollars to victims. In addition, there is an accusation linking Activision Blizzard to major political forces in the US.
