The company is seeking compensation for losses caused by Donald Trump’s tariff policies.
Nintendo of America has filed a lawsuit against the United States government. Through a complaint submitted to the country’s Court of International Trade, the company is demanding the full reimbursement, with interest, of all costs incurred as a result of the tariffs introduced by the Trump administration in 2025. The move has solid legal footing: on February 20, the US Supreme Court ruled that Trump’s tariff measures lacked sufficient legal basis, forcing the president to order their immediate repeal. What the ruling left unanswered, however, was what should happen to the more than $200 billion collected through those measures — and that is precisely the question Nintendo is now asking the courts to resolve, alongside Costco and FedEx, which have joined the complaint.
The odds of success appear favorable. Courts across the United States have already issued rulings stating that importing companies are entitled to full reimbursement of the amounts paid under the 2025 tariffs. The government, however, has not voluntarily returned the money to the affected companies, which is why Nintendo and its co-plaintiffs are seeking a binding judicial order compelling the executive branch to pay up. For larger companies, the sums in question could amount to hundreds of millions of dollars.
The longer-term outlook remains uncertain. Shortly after the unconstitutional tariffs were struck down, Trump introduced new ones based on different legislation. These have already been challenged by several states and companies, but the legal process could take months — during which Nintendo and other affected businesses will still be required to meet the new tax obligations.
The case may also have consequences for consumers. FedEx has been sued by its own customers seeking reimbursement for surcharges passed on as a result of the tariffs. Nintendo did not raise the price of the Switch or Switch 2 itself, but did increase the cost of certain accessories. Should the reimbursement claims prove successful, it is not out of the question that consumers could ultimately see some form of compensation as well.
