PlayStation 5: A Brazilian Court Rules Against Sony

The São Paulo Court of Justice has reportedly ordered Sony to „unblock” the PlayStation 5 consoles that got banned for violating Sony‘s terms of service.

Metropolis‘ Brazilian Portuguese article was translated on the ResetEra forums. Here, we read that those consoles that violated Sony’s ToS were practically bricked, meaning not only the accounts that broke the rules got banned but the consoles themselves were rendered unusable.

Unfortunately, it’s not clear if only the PlayStation 5 Digital Edition is affected or if the PlayStation 5 Standard Edition was also receiving some of these banhammers. In Brazil, the consoles are insanely expensive (due to import taxes and the like – a PlayStation 5 costs nearly 5000 BRL, which is nearly a thousand dollars; this is why even the PS2 is still highly popular in the country). Metropolis pointed out that „the device stops working and cannot be used for any purpose” after the console running illegal things gets caught. „It is as if you were accused of violating the terms of use of a streaming service – such as Netflix, for example – and were punished by permanently turning off your television, without being able to turn it on to watch open TV,” a legal expert told Metropolis.

Anderson Antonucci, the judge, noted that there was „danger of irreparable damage or difficult repair” when it comes to removing Sony’s theoretical „lock” on the PlayStation 5. We also don’t know if this situation is related to the PlayStation Plus Collection or not. Sony hasn’t responded to the ruling yet.

And on Twitter, the #NOPS5 hashtag quickly caught attention. Not everyone got a PlayStation 5 for Christmas (they likely still got more than nothing…), probably due to scalpers acquiring the small stocks that the retailers received. You can see a few examples of the tweets below.
